What is an EU Representative?
An EU Representative acts as contact person for EU based supervisory authorities and data subjects on all issues relating to a Non-EU based company’s processing of personal data within the scope of the General Data Protection Regulation (GDPR).
Why is this required?
If your company provides services or delivers products to customers in the European Union or you digitally monitor the behavior of people in the EU, the GDPR obliges, that you appoint a representative in the EU as the contact person for all questions on your processing of personal data from EU citizens and data protection supervisory authorities.
Why not ignore it?
- Non-compliance can result in onerous fines (up to EUR 20.000.000,00.)
- Non-compliance with the GDPR is often regarded as material breach in agreements with EU based customers
- Non-compliance can be a criminal offense
- EU based customers often require their Non-EU vendors to name an EU Representative
